The High Court has upheld the validity of BNP candidate Sarwar Alamgir’s nomination for the 13th parliamentary election, clearing the way for him to be sworn in as the Member of Parliament from Chattogram-2.

The High Court on Thursday ruled that BNP candidate Sarwar Alamgir is legally entitled to take oath as a Member of Parliament after declaring his candidacy for the 13th parliamentary election valid.

A High Court bench comprising Justice Fahmida Quader and Justice Md Asif Hasan delivered the verdict, making absolute the rule issued earlier in the case. The judgment effectively removes all legal barriers preventing Sarwar Alamgir from taking oath as the elected lawmaker from the Chattogram-2 constituency.

The court had concluded hearings on the rule on July 2 and fixed July 9 for delivering its verdict.

Senior advocate Ahsanul Karim and Barrister A M Mahbub Uddin Khokon represented Sarwar Alamgir during the hearing. Senior advocate Shishir Monir and advocate Azim Uddin Patwari appeared for Jamaat-e-Islami candidate Md Nurul Amin.

According to court documents, the dispute began after the Returning Officer declared Sarwar Alamgir’s nomination valid for the parliamentary election.

Following the Returning Officer’s decision, rival candidate Md Nurul Amin challenged the nomination before the Election Commission, alleging that Sarwar Alamgir was a loan defaulter and therefore ineligible to contest the election.

After hearing the appeal, the Election Commission on January 18 cancelled Sarwar Alamgir’s candidacy.

Challenging the commission’s decision, Sarwar Alamgir filed a writ petition with the High Court, seeking judicial review of the cancellation order.

On January 27, the High Court stayed the Election Commission’s decision and allowed him to contest the election while issuing a rule asking the authorities to explain why the commission’s decision should not be declared illegal.

The matter later reached the Appellate Division after Nurul Amin sought leave to appeal against the High Court’s interim order.

Although the Appellate Division granted leave to appeal, it directed that the official publication of Sarwar Alamgir’s election result would remain suspended until the appeal was finally disposed of.

As a result, despite winning the Chattogram-2 parliamentary seat in the election, his victory could not be officially gazetted, preventing him from taking oath as an MP.

The legal proceedings continued until June 16, when the Appellate Division instructed the High Court to dispose of the pending rule as quickly as possible, preferably within two weeks.

Complying with that directive, the High Court delivered its final judgment on Thursday, declaring Sarwar Alamgir’s nomination valid and making the earlier rule absolute.

The verdict removes the remaining legal uncertainty surrounding his election and clears the way for him to be sworn in as a Member of Parliament.

The case centred on whether the Election Commission acted lawfully in cancelling the BNP candidate’s nomination over allegations of loan default after it had already been accepted by the Returning Officer.

With Thursday’s ruling, the High Court effectively set aside the Election Commission’s decision and reaffirmed the legality of Sarwar Alamgir’s participation in the election.

Legal observers say the judgment concludes a months-long legal battle over the Chattogram-2 constituency that began before polling day and continued through several stages of judicial review.

The decision also resolves the uncertainty surrounding the representation of the constituency in the 13th Jatiya Sangsad.

Following the verdict, there is no longer any legal obstacle to Sarwar Alamgir taking oath as the elected Member of Parliament, unless any fresh order is issued by a higher court.

The ruling brings an end to one of the most closely watched post-election legal disputes involving candidate eligibility and the powers of the Election Commission in the run-up to the parliamentary polls.
